Judicial debt collection

Abstract:

Cílem této diplomové práce je vypracovat ucelený přehled procesu vymáhání bankovních pohledávek, zejména pak se zaměřením na vymáhání soudní. Teoretická část práce vychází z právní úpravy, odborné literatury a článků. Diplomová práce zpracovává problematiku komplexně od vzniku úvěrového vztahu, pohledávky a následného dlužného závazku. Zabývá se řešením vzniku pohledávky od raného vymáhání, až po soudní řízení. V závěrečné kapitole se autor věnuje úpravě hypotečních smluv a vyjadřuje zde svou myšlenku na možný právní výklad omezení o smluvních poplatcích.

Abstract:

The theme of this thesis is “Judicial debt collection”. The object is to develop a comprehensive overview of the process of recovery of bank receivables, especially with a focus on judicial recovery. The theoretical part of the work is based on legislation and literature and deals with the issue comprehensively from the origin of the credit relationship, receivable, and subsequent debt obligation. It deals with the solution of the origin of a claim from early recovery to court proceedings. The final chapter contains the regulation of mortgage contracts and expression of author´s idea of a possible judicial interpretation of restrictions on contractual fees.
