Abstract:

V této bakalářské práci je zkoumána vazba a její výkon v trestním řízení. Cílem je objasnit vazbu v trestním řízení, porovnat vazební důvody dle ustálené judikatury. V teoretické části byla použita metoda literární rešerše, zatímco praktická část zahrnovala dotazníkové šetření mezi studenty vysokých škol. Hlavní výsledky ukázaly, že pojem vazby je často asociován s vězením a dočasným zadržením, přičemž většina respondentů si není vědoma rozdílu mezi vazební věznicí a věznicí. Dále bylo odhaleno, že většina respondentů správně identifikovala soud jako výhradní orgán oprávněný rozhodovat o vazbě. Podrobný rozbor základních principů, jako jsou presumpce neviny a ultima ratio, které jsou neodmyslitelně spojeny s výkonem vazby, byl považován za zásadní přínos práce. Praktická část práce odhalila úroveň povědomí mezi studenty vysokých škol o institutu vazby a jejich postoj k němu. Z výsledků bylo zjištěno, že přes existující mezery ve znalostech studentů o specifikách a právních aspektech vazby, existuje obecné porozumění její důležitosti a účelu v rámci trestního řízení. Přínos práce spočívá ve zvýšení povědomí o vazbě, jejích důvodech, procesech a dopadech na obviněné, jakož i v posílení důležitosti dodržování základních právních principů a lidských práv v rámci trestního řízení.

Abstract:

In this bachelor's thesis, detention and its execution in criminal proceedings are examined. The aim is to clarify the concept of detention within criminal proceedings and to compare the reasons for detention according to established case law. The theoretical part utilized a literature review method, while the practical part included a survey among university students. The main results showed that the concept of detention is often associated with imprisonment and temporary detention, with the majority of respondents being unaware of the difference between a remand prison and a prison. Furthermore, it was revealed that most respondents correctly identified the court as the sole authority authorized to decide on detention. A detailed analysis of fundamental principles, such as the presumption of innocence and ultima ratio, which are inherently connected to the execution of detention, was considered a significant contribution of the work. The practical part of the thesis revealed the level of awareness among university students about the institution of detention and their attitude towards it. The results found that despite existing gaps in students' knowledge regarding the specifics and legal aspects of detention, there is a general understanding of its importance and purpose within criminal proceedings. The contribution of the work lies in increasing awareness about detention, its reasons, processes, and impacts on the accused, as well as in strengthening the importance of adhering to fundamental legal principles and human rights within criminal proceedings.
