Abstract:

Diplomová práce "Autorskoprávní problematika půjčování zvukových a zvukově obrazových záznamů v evropském kontextu" pojednává o legislativní úpravě a stavu půjčování zvukových a zvukově obrazových záznamů v knihovnách České republiky a v knihovnách vybraných států Evropské unie. Cílem práce je porovnání této problematiky u nás a v zahraničí s přihlédnutím k celoevropským trendům. Teoretická část práce je věnována právu autorskému a právům souvisejícím s právem autorským. Dále se práce zabývá úpravou těchto práv v autorském zákoně a novelou autorského zákona. Se zaměřením na oblast zvukových a zvukově obrazových záznamů jsou zde definování nositelé práv k těmto záznamům a obsah jejich práv. Zmíněna je rovněž problematika mezinárodní ochrany autorského práva a právní předpisy Evropské unie z oblasti autorského práva a práv souvisejících. Práce se věnuje také kolektivní správě práv a ochranným organizacím působícím na našem území. Analytická část práce se zabývá stavem půjčování zvukových a zvukově obrazových záznamů v českých knihovnách a dále v knihovnách vybraných států Evrospké unie, a to na Slovensku, v Estonsku, Dánsku, Lotyšsku a na Kypru. Závěr práce tvoří zhodnocení výše zmíněného porovnání a pohled do budoucna, jakým směrem by se mohlo půjčování zvukových a zvukově obrazových záznamů v České republice ubírat.

Abstract:

Diploma thesis Copyright problems of lending of sound and audiovisual records in European context deals with legislative modification and the state of lending of sound and audiovisual records in the libraries of Czech Republic and in the libraries of some European Union countries. The aim of the thesis is a comparison of these problems in our country and in the foreign countries with regard to all-European trends. Theoretical part of the thesis deals with copyright and the law associated with copyright. Furthermore the thesis describes modification of these laws in copyrigt. With a view to the field of sound and audiovisual records, there are defined right holders to the records and the content of their rights. I wrote as well about the amendment of the Czech copyright act, problems of international copyright protection and the legislation of European Union in the field of copyright and the rights associated with copyright. The thesis also deals with collective rights administration and copyright protection organizations applied in our area. Practical part of the thesis describes the state of lending of sound and audiovisual records in Czech libraries and further in the libraries of some European Union countries namely in Slovakia, Estonia, Denmark, Latvia and Cyprus. The conclusion is at the same time the evaluation of the comparison mentioned above and the look into the future which way could the lending of sound and audiovisual records in Czech Republic proceed.
