Implementation of Socially Responsible Public Procurement in the Czech Republic

Abstract:

Diplomová práce se věnuje zadávání veřejných zakázek, představuje institut odpovědného veřejného zadávání, povinnost obecně označovanou jako „OVZ“. Zásadu sociálně a environmentálně odpovědného zadávání a inovací přinesla k 1. 1. 2021 novela zákona č. 134/2016 Sb., o zadávání veřejných zakázek. Kvalifikační práce ve své první části představuje koncept OVZ a jeho metodiku. V další části se věnuje samotné novele, rozebírá její znění a popisuje okolnosti jejího vzniku. Teoretickou část tvoří zejména komentářová literatura a rozhodnutí ze strany Úřadu na ochranu hospodářské soutěže, protože judikatura v této oblasti stojí na samém počátku. Zákonodárce přenesl na zadavatele povinnost rozšířit předmět plnění o společenskou hodnotu (v podobě OVZ). Text si klade otázku, zda zvolená forma je tím nejlepším řešením a zda úprava de lege lata naplňuje dobře svůj smysl a účel. V návaznosti na diskuzi nad výhodami a nevýhodami platné právní úpravy, práce navrhuje alternativní pojetí OVZ, které má ambici být jednodušší, efektivnější a ve větším souladu s tržními principy. Předkládané řešení de lege ferenda pojímá OVZ jako „společenskou způsobilost“ a zavádí ji v podobě nové kvalifikace pro veřejné zakázky v nadlimitním režimu. Podstatou úpravy je požadavek na minimální poměr společenské způsobilosti dodavatele a jeho čistého obratu.

Abstract:

The diploma thesis focuses on public procurement, introducing the institute of responsible public procurement, an obligation generally referred to as "OVZ". The principle of socially and environmentally responsible procurement and innovation was introduced by the amendment to Act No. 134/2016 Coll., on Public Procurement and effective as of January 1st, 2021. The first part of this thesis introduces the institute of OVZ and its methodology. The second part concentrates on the amendment itself, analyses its wording and describes the circumstances of its creation. The theoretical part is based mainly on commentaries on the law and decisions of the Office for the Protection of Competition, as the case law in this area is very rare. The legislator has transferred the obligation, to expand the scope of procurement, to the contracting authority forcing it to include social value (in the form of OVZ). The analysis asks whether the chosen solution is the best one available and whether the de lege lata regulation accomplishes its sense and purpose well. Following a discussion on advantages and disadvantages of the current legislative regulation, the thesis proposes an alternative regulation of OVZ, which aspires to be simpler, more effective and more in line with market principles. The proposed de lege ferenda regulation treats OVZ as a 'social competence' and introduces it in the form of a new qualification for the above-threshold public contracts. The proposed legal regulation is based on a requirement to maintain minimum ratio of supplier's social competence to its net turnover.
