Abstract:

Tato práce zkoumá koncept synonymie a jeho využití v americké právní angličtině. Na základě amerických právních textů se zaobírá chováním slov, a to entitle a qualify, která jsou ve Websterově slovníku označena jako synonymická. Práce se snaží poznat možnosti jejich zaměnitelnost v kontextu právní angličtiny. První část práce představuje teoretickou základnu pro analýzu. Kapitola první pojednává o synonymii. Je v ní obsažena úvodní analýza, na které se demonstruje problematická definice synonymie. Dále jsou zde zmíněny důležité koncepty, Lyonsova a Crusova teorie, a nakonec nabízí úvahu o účelu synonymie v jazykovém systému. Následující kapitola se zabývá právnickou angličtinou jako specifickým jazykovým rejstříkem. Zkoumá její zvláštnosti a stručně nastiňuje klíčové momenty v jejím vývoji. Jedna celá podkapitola je věnována slovesům v právnické angličtině, jež poskytuje bližší vhled do problematiky tohoto slovního druhu. Poslední kapitola z teoretické části představuje korpusovou lingvistiku, nové odvětví jazykovědy, a ukazuje její užitečnost v oblasti výzkumu. Poslední kapitola se zabývá analýzou dvou vybraných sloves. Každé sloveso je doprovázeno bližšími informacemi (definice, původ slova, nálezy) a analýzou založenou na korpusových důkazech a výše zmíněných teoriích. Na závěr celé práce je poskytnuto celkové shrnutí výzkumu s přihlédnutím k teorii.

Abstract:

The present thesis examines the concept of synonymy and its employment in American legal English. Based on the material of American legal texts, it investigates the behavior of words, namely entitle and qualify, that are determined in Webster dictionary as synonyms. It strives to explore their interchangeability in this particular context. The first part of the thesis is dedicated to theoretical background, which introduces various arguments that are crucial for the analysis. The first chapter discusses the concept of synonymy. It offers an introductory analysis which reveals the problematic definition of synonymy. Then, it discusses two important concepts, namely Lyons' and Cruse's theories, and finally provides a sub-chapter about the purpose of synonymy in a language system. The next chapter deals with legal English as a specific register. It explores its specialties as well as briefly outlines the crucial moments in its development. One sub-chapter is devoted to verbs in legal English in order to closely specify this particular part of speech. The last chapter of the theoretical part introduces corpus linguistics as a branch of linguistics and proposes its usefulness in research. The last chapter analyzes the two selected synonyms. Each verb is provided with further information (definition, word origin and hits). The synonyms are discussed according to Lyons' and Cruse's concepts. Then, there is a conclusion of the research with regard to the theory.
