The phenomenon of refugees in the parliamentary election in Germany in 2017

Abstract:

Tato bakalářská práce se zabývá vlivem fenoménu uprchlictví na volební programy stran v parlamentních volbách v Německu, které proběhly v roce 2017. Komparuje přístup politických stran AfD, CDU/CSU a SPD. Cílem práce je posoudit, zda jsou volební programy v souladu s mezinárodněprávními závazky a zhodnotit který program se s nimi nejméně rozchází. Na začátku práce je popsáno metodologické hledisko.Následně jsou vysvětleny náležitosti mezinárodního práva a propojení vztahů mezinárodního, evropského a vnitrostátního práva, pro lepší pochopení celé struktury práce. Třetí kapitola popisující konkrétně společnou azylovou politiku a právo na azyl v Německu. Čtvrtá kapitola se věnuje pojmu uprchlictví a mezinárodní smlouvě s ním spojené,Úmluvě OSN o právním postavení uprchlíka. Pátá kapitola analyzuje a komparuje změny navrhované stranami v oblasti azylové politiky týkající se uprchlictví. Práce dochází k závěru, že dvě strany ze tří porovnávaných jsou v souladu s mezinárodněprávními závazky vztahujícími se ke společné azylové politice.

Abstract:

This bachelor thesis deals with the influence of the refugee phenomenon on party election programs in the parliamentary elections in Germany in 2017. The thesis compares the approach of three political parties, the CDU / CSU,AfD and the SPD. The aim of the thesis is to assess whether electoral programs are in line with international legal obligations and to evaluate which program is the least distant from the obligations. Firstly,the methodological aspect of the work is explained. Secondly, there are essentials of international law. Moreover, there are explained interconnections between international, European and national law relations, for better understanding of the whole structure of the work. Thirdly, there is a chapter describing specifically a common asylum policy and the right to asylum in Germany. Fourthly, the thesis deals with the concept of refugee and the international treaty connected with refugee phenomenon. Lastly, there is included an analysis and comparison of the changes proposed by the parties in the area of asylum policy. This thesis comes to solution, that only two parties out of the three are consistent with international legal obligation connected with a common european asylum policy.
