International Law and Islamic State: Selected Aspects

Abstract:

Tato diplomová práce se zabývá v současnosti nejdiskutovanějším tématem na poli mezinárodního práva, mezinárodních vztahů, politiky a bezpečnosti, a to Islámských státem. Tím, že Islámský stát je úplně novou a neznámou entitou, vyvstává mnoho dříve neřešených otázek. Bude pojednáno o otázce, zda Islámský stát lze právně považovat za stát a dále o souvisejících otázkách, zejména příslušnost trestních soudů v otázce členů IS. Druhá část se bude zabývat klasifikací Islámského státu jako teroristické organizace, a to zejména z hlediska národní i mezinárodní právní definice, a také použitím síly proti IS.

Abstract:

The topic of this diploma thesis is one of the most disussed current problem of international law, international relations, politics and security – the Islamic state. The fact that the Islamic state is a brand new and unknown entity causes a lot of unresolved problems. The main objective of the first part is defining the Islamic state as a state using Montevideo criteria and dealing with specific contextual questions, especially criminal courts jurisdiction in question of prosecution of IS members. The second part will deal with a classification of the Islamic state as a terrorist group using national and international legal framework and use of force against IS.
