Intellectual Property Law in the Framework of Obligations Law

Abstract:

Cílem diplomové práce je rozbor možností úpravy jednotlivých speciálních závazkových vztahů v kontextu nové obecné úpravy zákona č. 89/2012 Sb., občanský zákoník, ve znění pozdějších předpisů, konkrétně typových licenčních smluv a ostatních nepojmenovaných smluv. Autorka práce si klade za cíl zodpovědět otázku, zda je jediným vhodným nástrojem pro úpravu vztahů souvisejících s duševním vlastnictvím licenční smlouva a dále nakolik nová obecná úprava ovlivní oblast duševního vlastnictví.Práce je členěna na teoretickou část, kde jsou vymezeny jednotlivé pojmy a druhy duševních práv; a dále na analytickou část, jež je stěžejní a obsahuje rozbor právního pojetí věci a speciálních závazkových vztahů. Na základě analýzy jsou závěrem shrnuty nejpodstatnější body práce, zejména možnosti užití licenční smlouvy a potřebnost ostatních institutů a hodnocení zrušení typové licenční smlouvy k předmětům průmyslového vlastnictví.

Abstract:

The aim of this thesis is to analyze options for individual special obligations in the context of the new general regulations of the Law No. 89/2012 Sb., The Civil Code, as amended, especially typed license agreements and other nameless contracts. The writer aims to answer the question, whether is the only appropriate instrument for the regulation of relations associated with intellectual property the license agreement and how the new general regulation influence intellectual property. Thesis consists of a theoretical part where are defined the individual terms and the types of intellectual property, and the analytical part, which is primary and includes the analysis of the legal conception of thing and special obligations. Based on the conclusion of the analysis are summarized the most important points of the work, mainly the possibility of using the license agreement and the usefulness of other agreements and rating of cancellation of typed rating license agreement for industrial property.
