Imposing Sanctions in Construction Proceeding

Abstract:

Cílem práce je poskytnout přehled o sankčním řízení na úseku stavebního práva. Úkolem teoretické části je vymezit základní pojmy, charakterizovat správní delikt, přestupek, a rozdíly mezi nimi. Dále jsou uvedeny základní zásady správního trestání a pravidla pro ukládání jednotlivých typů sankcí za přestupky a správní delikty, včetně vymezení jejich funkcí. Praktická část se zaměřuje na ukládání sankcí za spáchané delikty uvedené ve sta-vebním zákoně. Následně je popsán proces uložení druhu sankce a její výměry. Praktickou část uzavírá hodnocení působení uložených sankcí na přestupce.

Abstract:

The goal of the diploma is to offer the view about sanction trial in the construction lien. The task of the theoretical part is to define fundamental terms, to characterize the adminis-trative delinquency, violation and the differences between them. Furthermore there are basic administrative sentencing principles and the rules for imposition of different types of violation and administrative delinquency penalties including the definition of their functi-on. The practical part deals with the imposition of the committed delinquency penalties written in the building act. Sequentially there is a description of the impassioning penalty proces and the penalty´s definition. The closure of the practical part is the evaluation, how imposition penalties effect on the delinquents.
