Abstract:

Tato bakalářská práce je věnována kriminalisticko-taktické metodě rekognice. Tato metoda je upravena v současném trestním řádu, kde je označována jako zvláštní forma dokazování. Práce obsahuje její historický vývoj, obecnou charakteristiku, typy a jejich stručný popis. Dále také obsahuje samotnou přípravu metody, včetně popsaných fází, popis provedení a dokumentaci. Na závěr jsou popsány možné chyby při realizování rekognice a v neposlední řadě návrhy na změny de lega ferenda. Po přečtení této práce by i nezainteresovaný laik měl bezproblémově pochopit význam a průběh provádění rekognice, včetně různých možností provádění. Na základě detailního studia této kriminalisticko-taktické metody, včetně dostupných odborných textů, a především na výsledcích provedeného průzkumu jsem přesvědčena, že rekognice má stále své nezastupitelné místo v rámci procesu dokazování a nelze ji zcela nahradit jinými, byť modernějšími, kriminalisticko-taktickými metodami.

Abstract:

This bachelor thesis is devoted to the criminalistic-tactical method of recognition. This method is regulated in the current Criminal Procedure Code, where it is referred to as a special form of proving. This work contains its historical development, general characteristics, types, and their brief description. Furthermore, it also contains the actual method preparation, including the described phases, the description of the implementation and the documentation. Finally, possible errors in the implementation of the recognition are described and last but not least; suggestions for changes de lega ferenda. After reading this work, even a disinterested layman should easily understand the meaning and course of conducting recognition, including the various options for conducting it. Based on a detailed study of this criminalistic-tactical method, including available professional texts, and especially on the results of the research carried out, I am convinced that recognition still has its irreplaceable place in the process of proving and cannot be completely replaced by other, albeit more modern, criminalistic-tactical methods.
