Legal Aspects of Selected Administrative Proceedings in the Field of Armed Forces

Abstract:

Obsahem této diplomové práce je problematika některých správních řízení o protiprávních jednáních vojáků z povolání a postavení velitele útvaru jako správního orgánu v nich. Vzhledem k specifické roli Armády České republiky v rámci struktury veřejné správy a zvláštního postavení vojska ve společnosti, je cílem této práce především přiblížit současnou právní úpravu správního nebo disciplinárního řízení v souvislosti s přestupky nebo kázeňskými přestupky příslušníků ozbrojených sil a dále postavení a chování jednotlivých subjektů v něm. Součástí práce je analýza a popis právního rámce, úvaha o jeho nedostatcích a zamyšlení se nad jejich možným řešením. V tématu je zohledněno postavení Vojenské policie, její postavení a úkoly v rámci řízení, a to především jako bezpečnostní složky, která v rámci správního řízení může na základě svých pravomoci výrazně přispět k objasnění a dokumentaci skutečností, které mají znaky zmiňovaného protiprávního jednání.

Abstract:

The content of this thesis is the issue of certain administrative proceedings on infringements of professional soldiers and the position of commander as an administrative authority in them. Due to the specific role of the Army of the Czech Republic within the governmental structure and the special position of the army in society, the aim of this work mainly introduce the current legislation administrative or disciplinary proceedings in connection with offenses or disciplinary misdemeanors of members of the armed forces and the status and behaviour of individual subjects him. Part of this work is the analysis and description of the legal framework, a reflection on its shortcomings and to give a thought about their possible solutions. The theme is taken into account the position of the Military Police, its role and tasks in the proceedings, especially as the security force, which may in the context of administrative proceedings, pursuant to its powers, significantly contribute to the clarification and documentation of the facts, which have the characteristics mentioned infringement.
