Neglect of the mandatory nutrition

Abstract:

Předmětem této práce byla analýza složitého tématu trestného činu spočívajícího v zanedbání povinné výživy. Téma tohoto typu vyžadovalo uplatnění analytické a souhrné metody. Bylo nutné definovat základní pojmy rodinného práva, které mohou mít dopad na trestní odpovědnost pachatele. Český pojem zanedbání povinné výživy má dva významy v angličtině. 1. Alimenty, které znamenají závazek poskytovat finanční podporu jedním manželem druhému, a to za trvaní manželství nebo po rozvodu a je založeno na předpokladu, že teoreticky oba manželé mají závazek se navzájem podporovat během manželství či po něm a 2. Výživné, kdy po rozvodu jeden z rodičů je povinen přispívat penězi na výživu dětí druhé z rodičů. To je důvodem proč je nutné v práci používat oba významy. První část práce se soustředila na detailní analyzu jednotlivých typů výživného a zvláště na definici předmětu, časování, trvání, rozsahu a ukončení. Hlavní část se týkala popisu právních aspektů obou trestných činů, včetně účinné lítosti. Závěry této práce naznačují, že není třeba bezprostředních legislativních změn. Nicméně by bylo vhodné uvažovat zavedení statní podpory pro případ, že pachatel přestane podporu hradit.

Abstract:

This study's objective was to analyse the complex topic of the criminal of-fence consisting of not providing of alimony or child support. Topic of this kind required the application of ananlytical and comilative method. It was necessary to define the relevant terms of family law which could have an implication on the criminal liability of an offender. The Czech term zanedbaní povinné výživy has two meanings in English 1. Alimony denoting a legal obligation to provide financial support to one's spouse from the other spouse after marital separation or from the ex-spouse upon divorce and is based on the premise that both spouses in theory have a legal obligation to support each other during their marriage or upon separation or divorce and 2. Child support where, after divorce, one parent is required to contribute to the support of their children by paying money to the child's other parent. That is the reason why both terms needed to be used. The first part of the thesis focused on a detailed analysis of individual types of alimony and child support, especially definition of the subjects, timing , duration, scope and its exipiration. The main part was about the description of legal aspect of both criminal offences, including effective repentance. This study's conclusions indicate that there is no need for legislative changes. However, introduction of a state subsidy in case that the offender stop to pay should be considered.
