Judicial Agenda Setting: A Case Study of The Constitutional Court of the Czech Republic

Abstract:

Disertační práce se věnuje nastolování soudní agendy, a to prostřednictvím případové studie Ústavního soudu České republiky (ÚS). Konkrétně zkoumá, jak advokáti, ústavní soudci a jejich asistenti ovlivňují, zda o určitém případu ÚS rozhodne meritorně, a na základě jakých faktorů se tito rozhodují, zda o meritorní projednání případu usilovat. Zjištění jsou diskutována nejen ve světle dosavadních empirických studií nastolování agend jiných soudů, ale i z praktického hlediska. Práce se tak vyjadřuje k účinnosti povinného zastoupení v řízení před ÚS či k možnosti přiznat ÚS diskreční pravomoc.

Abstract:

The dissertation focuses on the issue of courts‘ agenda setting and it does so on the basis of a case study of the Constitutional Court of the Czech Republic (CC). It analyses how lawyers, constitutional justices and their clerks influence what cases the CC reviews substantively and what factors influence their decision (not) to seek for the substantive review of a given case. Findings are discussed not only in relation to existing empirical studies of agenda setting in other courts, but also from a practical point of view. Therefore, the dissertation also briefly discusses efficiency of mandatory representation in the proceedings before the CC or the possibility of conferring the discretionary power to the CC.
