Regulation of short-term rentals in the Czech Republic and their impact on tourism

Abstract:

Cílem této bakalářské práce zjistit, jak jsou krátkodobé pronájmy právně regulovány v České republice, zhodnotit dostatečnost právní úpravy s ohledem na dopad krátkodobých pronájmů na cestovní ruch a navrhnout možná řešení a doporučení pro budoucí praxi. První část práce se zabývá definováním termínů jako „sdílená ekonomika” a „sdílené ubytování“ a jsou uvedena specifika tohoto typu ekonomiky s důrazem na sdílené ubytování. V další části práce jsou analyzovány platné právní předpisy týkající se krátkodobých pronájmů. Hlavním předmětem je rozdíl mezi pronájmem a ubytovací službou s důrazem na povinnosti pronajímatelů a poskytovatelů ubytovacích služeb. Nakonec je zhodnocen dopad krátkodobých pronájmů na cestovní ruch ČR a podle aktuální právní úpravy a podle způsobů regulace ve vybraných evropských státech jsou představovány doporučení a možná řešení.

Abstract:

The aim of this bachelor thesis is to find out how the short-term rentals are legally regulated in the Czech Republic, evaluate its sufficiency with respect to its impact on the tourism industry and suggest possible measures and recommendations for future practice. First the terms regarding this issue, like ‘sharing economy’ or ‘apartment sharing’, are defined and the specifics of this type of economy are outlined, with the main focus on apartment sharing. Then the legal sources regarding short-term rentals are analysed. The main subject is the difference between rent and accommodation service with the emphasis on the obligations of the lessors, respectively accommodation service providers. Lastly, the impact of the short-term rentals on tourism is assessed and recommendations based on the current legal regulation as well as methods of regulation in selected European countries are given.
