Civil Law Regulation of Cryptocurrencies and Perspectives of Their Regulation

Abstract:

Práce se zaměřuje na ukotvení kryptoměn v oblasti českého občanského práva. Nejprve je stručně popsáno fungování protokolu blockchain a kryptoměn. Jako výchozí bod pro další text jsou nejprve kryptoměny klasifikovány jako věc ve smyslu občanského zákoníku. Na tento závěr navazuje analýza toho, jakým způsobem lze prostřednictvím kryptoměn realizovat vybrané instituty občanského práva z oblasti absolutních majetkových práv a relativních závazkových práv. Z práv absolutních se práce věnuje vlastnickému právu, zástavnímu a dědickému právu. V oblasti relativních závazkových práv se práce věnuje otázce úhrady ceny prostřednictvím kryptoměny, realizaci institutu nabídky a akceptace při převodu kryptoměny a elektronickému podpisu transakce. Zohledněna je také otázka mezinárodní práva ve vztahu k dosaženým závěrům. V závěrečné části pak text porovnává užití klasických kryptoměn typu bitcoin s tzv. stablecoins a věnuje se otázkám souvisejícím s jejich případnou právní regulací.

Abstract:

This rigorous thesis is focused on anchoring cryptocurrencies in the area of the Czech civil law. First, the functioning of the blockchain protocol and cryptocurrencies is briefly described. As a starting point, cryptocurrencies are classified as “a thing” in a legal sense. This conclusion is followed by the analysis of the possibilities of the use of cryptocurrencies within selected institutes of the Czech civil law from the field of the absolute property rights and the relative property rights. Ownership rights, pledge and the law of succession is selected from the area of the absolute property rights. The text focuses on the payment of a prize with a cryptocurrency, realisation of the institute of offer and acceptance and electronic signature within a transaction with the use of a cryptocurrency. A question of the international law with regards to the conclusions reached is also taken into account. Final part of the thesis compares the use of classic cryptocurrencies like Bitcoin and so called stablecoins and also deals with the questions related to their regulation.
