Protection of the Consumer in their Capacity as a Bank Client

Abstract:

Cílem této bakalářské práce je zpracování textu, který se zabývá ochranou spotřebitele (slabší smluvní strana) v oblasti bankovnictví. Práce je rozdělena do čtyř kapitol. Teoretická část práce je věnována základnímu vymezení pojmů, jako je spotřebitel, banka či klient banky, zmíněny jsou také právní předpisy vztahující se k ochraně spotřebitele. V teoretické části je věnován prostor i angažovaným subjektům ve sféře ochrany spotřebitele (Česká národní banka, Úřad pro ochranu osobních údajů, Česká obchodní inspekce), také soudní ochraně a mimosoudnímu řešení spotřebitelských sporů (Alternative Dispute Resolution). V závěru teoretické části jsou zmíněny nástroje a opatření, která se vztahují k ochraně spotřebitele (bankovní tajemství). Aplikační část bakalářské práce obsahuje komparaci přístupu univerzální banky (Fio banka, a.s.) a nebankovní instituce - platební instituce Zonky (Benxy s.r.o.) při ochraně spotřebitele, a to se zaměřením na posouzení úvěruschopnosti klienta.

Abstract:

The aim of this bachelor’s thesis is the elaboration of a text which deals with protection of the consumer (the weaker contracting party) in the banking sector. The thesis is divided into four chapters. The theoretical part of the thesis is devoted to a basic definition of terms such as consumer, bank and bank client. The legislation related to consumer protection is also mentioned here. In the theoretical part, space is also given to the entities involved in the consumer protection sector (the Czech National Bank, the Office for Personal Data Protection and the Czech Trade Inspection Authority), as well as to the judicial protection and out-of-court resolution of consumer disputes (Alternative Dispute Resolution). The tools and measures related to the consumer protection (banking secrecy) are mentioned in the end of the theoretical part. The applied part of the bachelor’s thesis offers comparison of the approach taken by a universal bank (Fio banka, a. s.) and a non-banking institution - the payment institution Zonky (Benxy s.r.o.) to consumer protection with regard to the assessment of a client’s creditworthiness.
