Detection and Prevention of Insurance Frauds in Non-life Insurance

Abstract:

Tato diplomová práce zkoumá problematiku trestného činu pojistného podvodu na českém pojistném trhu. V úvodní kapitole jsou vysvětleny základní principy a úlohy pojištění a pojem pojistného rizika. V následující kapitole jsou rozebírány právní aspekty trestného činu pojistného podvodu a úpravy trestního zákona. Třetí kapitola se věnuje situaci na českém pojistném trhu z hlediska vývoje počtu pojistných podvodů, vzniklých škod a událostí, které trh ovlivnily. Čtvrtá kapitola popisuje prevenci proti pojistným podvodům a metodiku jejich vyšetřování. Závěrečné kapitoly se věnují odhalování nedostatků v činnosti pojišťoven a tvorbě profilu typického pachatele pojistného podvodu.

Abstract:

The thesis examines the issue of insurance fraud crime in the Czech insurance market. The basic principles, the role of insurance and the concept of insurance risk are explained in the introductory chapter. Next chapter deals with the legal aspects of the crime of insurance fraud and criminal law rules. In the third chapter, the author analyses situation in the Czech market in terms of developments of insurance fraud, damages and events that influenced the market. The fourth chapter describes the insurance fraud prevention plans and the investigation methodology. The final part of the thesis aims to identify the gaps in the insurance business and build a profile of the typical perpetrator of insurance fraud.
