Procuration in Theory and Reality
Abstract:
Práce je zaměřena na současnou právní úpravu zastoupení na základě plné moci a její použití v praxi. Dále se zabývá problematickými změnami v Novém občanském zákoníku a jejich dopadem na využití plné moci. Cílů je dosaženo za pomocí komentáře k jednotlivým ustanovením, analýzou soudního usnesení, dotazníkovým šetřením a konkrétními příklady využití.
Abstract:
Thesis is focused on current legislation of procuration on the basis of power of attorney and its use in practice. It further focuses on problematic changes in the New civil code of law and their influence on power of attorney usage. This is achieved through commentary of individual provisions of the law, analysis of judical resolution, a survey and specific examples of use in practice.
