Abstract:

Služební poměr a jeho regulace v právním řádu hrají klíčovou roli v zaměstnaneckých vztazích. Zákon č. 361/2003 Sb., o služebním poměru příslušníků bezpečnostních sborů, představuje kámen milník v právním zakotvení práv a povinností zaměstnanců v této oblasti. Tato bakalářská práce se zaměřuje na důkladnou analýzu výhod a omezení, která vyplývají ze služebního poměru podle uvedeného zákona. Tato práce se zabývá komplexní analýzou problematiky služebního poměru. Teoretická část rozebírá zákon č. 361/2003 Sb., o služebním poměru příslušníků bezpečnostních sborů, se zaměřením na klíčové aspekty, jako jsou vznik a skončení služebního poměru, povinnosti a omezení práv příslušníků a doba služby a odpočinku. Praktická část práce navazuje dotazníkovým šetřením, které proběhlo u příslušníků Vězeňské služby ČR sloužících ve Věznici Břeclav. Cílem šetření bylo zmapovat názory příslušníků na proces přijímacího řízení a samotný výkon profese a shromáždit relevantní data o jejich vnímání jednotlivých kroků a požadavků. Výsledky šetření přinesly kombinaci pochopitelných, očekávaných i neočekávaných poznatků, které pomohly k hlubšímu pochopení problematiky a k formulaci vlastních doporučení pro potenciální uchazeče o vstup do bezpečnostních sborů, ale i zkušenějších příslušníků. Tato doporučení shrnuje závěrečná část práce a slouží jako praktický návod pro uchazeče, kteří se ucházejí o kariéru v bezpečnostních složkách. Práce tak komplexně propojuje teoretické poznatky s praktickým šetřením a přináší cenný vhled do problematiky přijímacího řízení do bezpečnostních sborů.

Abstract:

Service employment and its regulation in the legal system play a key role in employment relations. Act No. 361/2003 Coll., on the service employment of employees in public services, represents a milestone in the legal anchoring of the rights and obligations of employees in this area. This bachelor thesis focuses on a thorough analysis of the advantages and limitations that arise from service employment under the aforementioned law. This thesis provides a comprehensive analysis of the issues related to the service relationship. The theoretical part examines Act No. 361/2003 Coll., on the Service Relationship of Members of Security Forces, focusing on key aspects such as establishment and termination of the service relationship, obligations and restrictions of the rights of members, working hours and rest. The practical part of the work is followed by a questionnaire survey, which took place among members of the Prison Service of the Czech Republic serving in Břeclav Prison. The aim of the survey was to map the opinions of members on the admissions process and the performance of the profession itself, and to collect relevant data on their perception of individual steps and requirements. The results of the investigation yielded a combination of understandable, expected and unexpected findings that helped to gain a deeper understanding of the issue and to formulate their own recommendations for potential candidates to join the security forces, as well as more experienced members. These recommendations summarize the final part of the thesis and serve as a practical guide for applicants seeking a career in the security forces. The thesis thus comprehensively links theoretical knowledge with practical research and provides valuable insights into the issue of the recruitment process for security forces.
