Abstract:

Cílem diplomové práce je rozbor specifických funkcí poznámek překladatele v právním překladu včetně důsledků jejich použití. Úvodní kapitola nabízí přehled relevantních aspektů právního jazyka a právního překladu v kontextu využívání poznámek překladatele. Následuje několik teoretických poznámek k obecné charakteristice a typologii poznámek překladatele. Pátá kapitola zkoumá použití poznámek překladatele jako produkt překladatelských norem a zabývá se analýzou vzájemné provázanosti mezi rozhodnutími jednotlivých překladatelů, profesními pokyny a předpisy a očekáváním klientů. Praktický výzkum, jež je zařazen do čtvrté kapitoly, je založen na analýze překladů právních textů přeložených zaměstnanci české překladatelské agentury specializující se na právní překlady. Analýza se zaměřuje na typologii situací, které přiměly k použití poznámky překladatele v konkrétních textech, a jak jsou tyto poznámky odvislé od druhu textu, směru překladu a skutečnosti, zda se jednalo o překlad úředně ověřený či nikoli. Výsledky tohoto výzkumu jsou poté zasazeny do širšího teoretického rámce rozvedeného v úvodních kapitolách a na základě toho jsou rovněž přijaty tomu odpovídající závěry.

Abstract:

The present thesis explores the various context-specific functions of translator’s notes in legal translation, along with the implications of their utilisation. The introductory chapters provide an overview of the relevant aspects of legal language and legal translation in the context of the use of translator’s notes, followed by several theoretical remarks on the general characteristics and typology of translator’s notes. The fifth chapter examines the use of translator's notes in legal translation as a norm-governed behaviour and analyses the mutual interdependency of translators‘ decisions, professional guidelines and policies and expectations of clients. The research in the final chapter is based on the analysis of legal texts translated by translators working for a Czech translation agency specialising in legal translation. The analysis focuses on the different types of textual situations that warranted the use of a translator’s note in each of the texts and how this varies depending on the type of the text, translation direction and on whether or not the translation was certified by a sworn translator. The results of the research are placed in the broader theoretical framework established in the introductory chapters and corresponding conclusions are drawn.
