The Position of the Person Aggrieved and the Victim in the Criminal Proceedings - is the New Legislation More Beneficial to them?

Abstract:

Tématem diplomové práce je postavení poškozeného a oběti v trestním řízení, s důrazem na novou právní úpravu a její přínos. Cílem práce je nejen zjištění přínosu nové právní úpravy, ale také vyhledání a odstranění největších chyb stávající právní úpravy. Pro lepší pochopení tématu jsou v první kapitole rozebrány pojmy poškozeného, oběti a zvlášť zranitelné oběti, kde jsou zohledněny i jejich rozdíly. Následující kapitola se zabývá starší úpravou práv obětí a poškozeného, a také procesem vzniku nové právní úpravy. Třetí kapitola je jádrem diplomové práce, je zde podrobně popsán zákon č. 45/2013 Sb., o obětech trestných činů. Další kapitola se pak rozebírá největší nedokonalosti v právu poškozeného a oběti a pokouší se najít jejich řešení. V poslední části je pak rozebrán soulad české právní úpravy s nejzákladnější úpravou Evropské unie.

Abstract:

The topic of this diploma thesis is the position of aggrieved person and a victim in criminal proceedings, with emphasis on a new legislation and its benefits. The main goal of this diploma thesis is not just determining benefits of the new legislation, but also finding and removing the biggest problems of the legislation. In the first chapter are described an aggrieved party, a victim, a particularly vulnerable victim and their differences. This is very important for better understanding of the topic. Next section deals with older laws and the process, which led to formation of the new legislation. The third section is a main part of the diploma thesis. It describes new legislation, especially the law no. 45/2013 coll., victims of crimes. Next section shows the major problems of the new legislation and tries to offer some solutions. The last section is about harmony between the Czech legal system and the European Union legislation.
