The ombudsman

Abstract:

Tématem předkládané bakalářské práce je instituce veřejného ochránce práv, jakožto nástroje pro kontrolu orgánů veřejné správy. Hlavním cílem této práce je charakterizovat a analyzovat tuto instituci jako takovou. Dílčím cílem je pak srovnání instituce veřejného ochránce práv v České a Slovenské republice a vytýčení shodných a neshodných znaků v obou státech. Teoretická část bude rozdělena do tří hlavních částí, přičemž první se bude obecně zabývat institucí ombudsmana, bude zde vymezen samotný pojem ombudsmana, dále pak popsán historický vývoj této instituce ve světě a vytyčeny hlavní znaky, kterými by měl ombudsman disponovat. Druhá část práce se bude věnovat veřejnému ochránci práv v České republice a bude popisovat nejen jeho historický vývoj v této zemi, ale také jeho pravomoci a činnosti a v neposlední řadě i právní úpravu této instituce. Třetí a poslední část bude věnována veřejnému ochránci práv na Slovensku, přičemž zde bude provedena stejná analýza jako v předchozí části. V praktické části autorka pak provede srovnání informací zjištěných v teoretické části. Tato komparace přinese poznatky o tom, jaké jsou odlišnosti či podobnosti těchto dvou institucí ve dvou různých zemích.

Abstract:

The topic of the submitted bachelor thesis is the institution of the Public Defender of Rights, as a tool for the control of public administration bodies. The main purpose of this work is to characterize and analyze this institution as such. A partial purpose is to compare thi isntitution in the Czech and Slovak Republics and to identify identical or non-identical features in both countries. The theoretical part will be divided into three main parts, the first will deal the institution of the ombudsman, the concept of the ombudsman will be defined, the historical process of this isntitution in the world will be described and the main features of the ombudsman will be outlined. The second part of the thesis will focus on the ombudsman in the Czech Republic and will describe not only his historical process in this country, but also his powers and activities and, last but not least, the legal regulation of this institution. The third and final part will be devoted to the Public Defender of Rights in Slovakia, while there will bet he same analysis as in the previous part. In the practical part, the author thne compares the information found in the theoretical part. This comparsion will provide insights into the differences or similarities between the two institutions in two other countries.
