Abstract:

Předmětem této diplomové práce je analýza peněžitého trestu, jakož to alternativy k ukládání krátkodobých trestů odnětí svobody. Peněžitý trest je považován za efektivnější a levnější formu řešení trestních sankcí. Hlavním cílem této práce je zejména hledání odpovědí na otázky: za jakých podmínek, v jaké výměře a jaké míře a zda vůbec je peněžitý trest v rozhodovací praxi ukládán. Současně s tímto hlavním cílem práce je provedeno srovnání s úpravou peněžitého trestu ve Spolkové republice Německo. První kapitoly této práce se věnují především nezbytným výkladům základní teorie a pojmosloví z oblasti práva hmotného, které úzce souvisí se zkoumanou problematikou (pojem a účel trestu, pojem peněžitý a alternativní trest, problematika alternativního řešení trestních věcí). V souvislosti s nutností pochopení trestu a peněžitého trestu v kontextu jeho vzniku a vývoje byla zařazena i kapitola historického exkurzu k této problematice. V následující části je již proveden rozbor platné právní úpravy peněžitého trestu ukládaného dospělým pachatelům trestných činů, ale i peněžitého opatření ukládaného pachatelům mladistvým. Nejmarkantnější změnou v této oblasti je zavedení nového systému výměry peněžitého trestu prostřednictvím tzv. denních sazeb. V posledních kapitolách je provedena analýza peněžitého trestu z pohledu jeho ukládání v rozhodovací praxi českých soudů v letech 2009 a 2010, kdy došlo v České republice k zásadní změně trestního práva hmotného, a následují formulace úvah de lege ferenda

Abstract:

This diploma thesis deals with the issue the Analysis of the financial penalty as well as alernatives of sentencing short-term imprisonment penalties. The financial penalty is thought of the most efficient and cheaper form of penal sanction resolution. The main aim of this diploma thesis is especially response searching on these questions: under what conditions, which penalty and whether or not is the financial penalty sentenced in decision practise. At the same time with main aim of this diploma thesis is implemented the confrontation with adaptation financial penalty in Germany. The first chapters of this diploma thesis are attend to necessary comments the basic theory and the terminology of absolute law which is closely relate to examining problems ( conception and penalty object, conception financial and alternative penalty, problems of alternative solutions criminal cases). In context of comprehension origin and development the penalty and the financial penalty was filed the chapter historical excursion to this problems. In the following part is analysis implemented in valid legal regulations of the financial penalty sentenced to adult´s offenders, but the financial provision sentenced to juvenile. The most prominent change in this field is the implementation of the new finacial penalty system by means of the daily penalties. In the last chapters is realized the analysis of the financial penalty with the view of sentencing decision practise czech Courts in 2009 and 2010 when became in the Czech Republic changeover of Criminal material law and the next expressions de lege ferenda.
