Tax Criminality in the Czech Republic

Abstract:

Předmětem předkládané diplomové práce s názvem Daňová kriminalita v České republice je shrnutí daňové trestné činnosti páchané na území našeho státu a forem jejího trestněprávního postihu z hlediska jednotlivých skutkových podstat trestných činů vymezených v trestním zákoně. Zároveň je poukázáno na vývoj inkasa u vybraných druhů daní a cla, na počet a výsledky daňových a celních kontrol a na vývoj daňových i celních nedoplatků, a to včetně jejich grafického pojetí. Smyslem práce je navrhnout několik opatření na řešení daňových úniků a formy ochrany proti daňovým deliktům, jako je provázanost práva daňového, správního a trestního, boj proti daňovým rájům či harmonizace daní v Evropské unii.

Abstract:

The subject is presented with a thesis entitled Tax criminality in the Czech Republic is a summary of the tax crimes committed in the territory of our state and its forms of criminal sanctions in terms of individual constituent elements of crimes defined in the Criminal Code. It is also noted the development of collections of selected types of taxes and duties, the number and results of fiscal and customs controls and the development of tax and customs arrears, including the graphic concept. The purpose of this work is to propose several measures how to tackle tax evasion and to gain protection against tax offences as of the tax law, administrative and criminal, the fight against tax havens and tax harmonization in the European Union.
