Legal aspects of payment services in the Czech Republic

Anotácia:

Diplomová práce se věnuje právním aspektům platebních služeb na úrovni České republiky. První část je věnována historii a vývoji regulace v oblasti platebního styku, s uvedením nejdůležitějších právních předpisů a problémů, které tyto předpisy řešily a řeší. Větší část této uvodní části je věnována směrnici PSD2, která spolu se směrnicí PSD1 tvoří základní stavební kámen moderní regulace platebních služeb. Ve druhé části jsou rozebírány principy a mechanismy regulace platebních služeb, s uvedením role a funkcí České národní banky, včetně funkce dohledu nad poskytovateli platebních služeb. Třetí a současně poslední část práce se pak zaobírá nedostatky současné právní úpravy platebních služeb v České republice a provádí její komparaci s navrhovanou úpravou uvedenou v návrhu směrnice PSD3. Dále jsou pak uvedeny návrhy na zlepšení. Práce využívá metody analýzy a komparace. Závěrem je pak provedeno zhodnocení stanovených cílů.

Abstract:

The thesis examines the legal aspects of payment services at the level of the Czech Republic. The first part is devoted to the history and development of the regulation in the field of payment services, with a presentation of the most important legal regulations and the problems that these regulations have solved and are solving. The major part of this introductory part is devoted to PSD2, which together with PSD1 forms the cornerstone of modern regulation of payment services. The second part discusses the principles and mechanisms of payment services regulation, outlining the role and functions of the Czech National Bank, including its function of supervising payment service providers. The third and final part of the thesis deals with the shortcomings of the current regulation of payment services in the Czech Republic and compares it with the proposed regulation in the draft PSD3. Suggestions for improvement are then presented. The thesis uses the methods of analysis and comparison. Finally, an assessment of the objectives is made.
