Abstract:

Diplomová práce s tématem Dokazování v trestním řízení se věnuje jedné z nejdůležitějších fází trestního řízení, která prochází všemi stádii trestního řízení. Cílem diplomové práce je na základě teoretických poznatků, informací vycházejících z platné legislativy a vlastních zkušeností jednak najít odpověď na otázky, jaký vliv má porušení jednotlivých základních procesních pravidel platných pro výslech svědka na účinnost tohoto důkazu, zda chybné nebo chybějící poučení svědka má vliv na zákonnost nebo použitelnost výslechu svědka, zda je vhodný demonstrativní výčet důkazních prostředků či výčet taxativní, jednak potvrdit, nebo vyvrátit stanovenou hypotézu, chybné poučení svědka vede k relativní neúčinnosti výslechu svědka. Cíli je podřízena i struktura práce. První část tvoří teoretický rámec tématu. Vymezuje základní terminologii, zásady dokazování, jeho předmět a rozsah, nabízí přehled rozdělení a hodnocení důkazů, dotkne se i problematiky účinnosti těchto důkazů při procesu dokazování. Druhá část se věnuje problematice použitelnosti důkazů v trestním řízení s ohledem na výslech svědka. Při zpracovávání tématu diplomové práce byl proveden kvantitativní výzkum za využití obecně poznávacích metod, jako jsou analyticko-syntetická metoda, komparační metoda, metoda generalizace a metoda dedukce.

Abstract:

The diploma thesis on Evidence in Criminal Proceedings deals with one of the most important stages of criminal proceedings, which goes through all stages of criminal proceedings. On the basis of theoretical knowledge, information based on the legislation in force and own experience, the aim of the thesis is to find an answer to the questions of what effect the violation of individual basic procedural rules applicable to the examination of a witness has on the effectiveness of this evidence, whether erroneous or missing witness instruction affects the legality or applicability of witness examination, whether a demonstrative list of evidence or an exhaustive list is appropriate, and to confirm or refute the hypothesis that erroneous witness instruction leads to the relative ineffectiveness of witness examination. The structure of the thesis is also subordinate to the objective. The first part consists of the theoretical framework of the topic. It defines the basic terminology, principles of evidence, its subject and scope, offers an overview of the division and evaluation of evidence, and touches upon the issue of the effectiveness of such evidence in the process of proof. The second part deals with the issue of the applicability of evidence in criminal proceedings with regard to the examination of a witness. In elaborating the topic of the thesis, quantitative research was conducted using general cognitive methods such as the analytical-synthetic method, the comparative method, the method of generalization and the method of deduction.
