The Impact of the amendment to the law no.359/1999 in Legal Code about the social and legal protection of children of foster parent´s life.

Abstract:

Bakalářská práce je zaměřena na pěstounskou péči a novelu zákona č. 359/1999 Sb., o sociálně-právní ochraně dětí. Hlavním cílem práce je zjistit dopady této novely na život pěstounů. Autor ve své práci zmiňuje historické mezníky ve vývoji pěstounské péče a její současnou podobu. V práci jsou rozebrány cíle, které si novela vymezuje a uvedení legislativní změn do praxe. Na základě rozhovorů s respondenty jsou definovány oblasti, ve kterých novela ovlivňuje jejich život. Taktéž jsou v práci zmíněna možná rizika, která s přijetím legislativních změn souvisí. Novela zákona č. 359/1999 Sb., nalézá své příznivce i odpůrce z řad odborníků v péči o děti, nejpodstatnější je však názor lidí, kterých se bezprostředně týká, tedy pěstounů. S novelizací se otevírají nové možnosti pro pěstounské rodiny, které mohou být po počátečních těžkostech jistým přínosem.

Abstract:

The thesis is focused on foster care and on law amendment no. 359/1999 about the social and legal protection of children. The main objective of this work is to determine the impacts of this amendment on the foster parents´ life. At the beginning the author mentions the historical milestones in the foster care evolution and its current state. Later the work moves on the analysis of the aims, defined by the amendment and also on the changes which were made to legislation and their influence on people´s lives. The author tries to show the influence on the respondents´ lives, basing it on the dialogues with the respondents. There are also potential risks mentioned that are closely related to those legislative changes. Law amendment no. 359/1999 about the social and legal protection of children finds many supporters as well as its opponents among child care specialists. However, foster parents ´s opinion should become the most important because they are the people whom it concerns. The amendments are opening new pathways to opportunities for foster families who, after initial difficulties, might become a huge contribution.
