Imposing sanctions for administrative offences criteria

Abstract:

Tato bakalářská práce se zabývá problematikou hledisek pro ukládání sankce za správní delikt. Nejprve je v práci krátce představena funkce trestání, správní uvážení a problematika odůvodnění správního rozhodnutí. Z obecných hledisek a zásad je pozornost věnována zásadě subsidiarity trestní represe a zásadě rychlosti, tyto dvě obecné zásady jsou představeny v úzké souvislosti s trestním právem. Konkrétní hlediska pro ukládání sankce za správní delikt jsou pojednána v úzké souvislosti s připravovaným novým zákonem o přestupcích.

Abstract:

This bachelor thesis deals with the issues of standpoints for imposing the sanction for the administrative delict. First, the function of punishment, administrative discretion and issues for rationalization of administrative decision are introduced in this thesis. From the general point of view the attention is paid to the rule of the subsidiarity of criminal repression and the rule of speed. These two general rules are presented in the close connection with the criminal law. The new law about offence is in the preparation. In close connection with this law the concrete viewpoints for imposing sanction for administrative delict are dealt with.
