Complaints and complaint proceedings in the Retail Environment

Abstract:

Bakalářská práce se zabývá institutem reklamací a reklamačního řízení v maloobchodním prostředí. Cílem práce je analýza současných práv a povinnosti spotřebitelů i prodávajících při nákupu zboží a reklamacích v kamenných a internetových provozovnách. Popisuje zákonné předpisy, které se týkají reklamačního řízení. Práce poskytuje odpovědi na nejčastější otázky, které zákazníky zajímají při vyřizování reklamací. Jsou zde vymezeny instituce, na které se mohou nespokojené subjekty trhu obrátit v případě reklamačního sporu.Praktická část práce uvádí konkrétní příklady reklamačních sporů. Spotřebitelským výzkumem je zjišťována spokojenost spotřebitelů a maloobchodních prodávajících se zákonnými podmínkami, které se týkají reklamací, a spokojenost s jejich aplikací v praxi. Díky výsledkům dotazníkového šetření jsou v závěru doporučena opatření, která by mohla vést k vyšší ochraně spotřebitelů i prodejců. Výstupem bakalářské práce je ucelený text, který bude průvodcem pro spotřebitele i prodávající ve zvýšení jejich právního povědomí.

Abstract:

The bachelor thesis deals with complaint institute and complaint procedure in retail environment. The objective of this work is the analysis of the current rights and obligations of consumers and sellers in the purchase of goods and complaints in brick shops and internet places of business. The work describes the legal provisions which relate to the complaint procedure. It also provides answers to the most frequent questions that customers are interested in, and deals with complaints. The institutions are defined here, where unsatisfied market participants can turn to in case of complaint dispute.The practical part of the bachelor thesis presents certain examples of complaint disputes. The consumer research examines the satisfaction of consumers and retailers with the legal conditions relating to complaints and satisfaction with their application in practice. Thanks to the results of the questionnaire survey, certain measures are recommended at the conclusion part. They may lead to higher protection of the customers and retailers. The output of the bachelor thesis is a comprehensive text that will be a guide for consumers and sellers in increasing their legal consciousness.
