Healthcare services within the functioning of the internal market in the case-law of the Court of Justice and EU law

Abstract:

Rigorózní práce si klade za cíl prostřednictvím analýzy práva EU a judikatury Soudního dvora EU zmapovat zdravotnické služby a možnost jejich volného pohybu v EU. Pozornost je věnována zejména právu občanů EU jako pojištěnců zvolit si poskytovatele zdravotní péče, který se nachází v jiném členském státě než ve státě pojištění. Po obecných kapitolách, vymezujících základní pojmy včetně samotného pojmu zdravotnických služeb, práce analyzuje rozhodovací praxi Soudního dvora EU k otázkám možných omezení přeshraničního poskytování zdravotní péče, zejména s ohledem na požadavek předchozího povolení a náhradu vynaložených nákladů. Dále se práce zabývá legislativními iniciativami ke zdravotnickým službám, zejména směrnicí o službách a směrnicí o uplatňování práv pacientů v přeshraniční zdravotní péči. V neposlední řadě si práce klade za cíl poukázat na některé otázky přeshraničního poskytování zdravotní péče z pohledu České republiky, zejména v souvislosti z implementací zmíněné směrnice a informovaností českých pojištěnců ze strany českých zdravotních pojišťoven.

Abstract:

This thesis aims to analyse systematically the healthcare services and their cross-border provision as a part of the internal market, as articulated by case-law of the EU Court of Justice and reflected in EU law. The thesis focuses in particular on rights of patients who decide to travel abroad to undertake healthcare and what rights do they have with respect to reimbursement of their costs. After introductory chapters analysing healthcare services as such, the thesis deals with the case-law of the EU Court of Justice with respect to their cross-border provision and possible limitations thereto including requirement of authorisation with respect to reimbursement of their costs. Besides the case-law the thesis analysis EU law concerning cross-border provision of healthcare, not only primary law, but also regulations and in particular legislative initiatives such as services directives or directives on the application of patients’ rights in cross-border healthcare. Last but not least, the thesis provides a brief commentary on the implementation of the directive in the Czech Republic and on access of patients to information regarding the cross-border provision of healthcare.
