Abstract:

Bakalářská práce se zabývá srovnáním pravomocí Ústavních soudů po roce 1918 a 1989. Tedy Ústavních soudů za první republiky a současného. Dospěl jsem k závěru, že dnešní soud má výrazně větší pravomoci a také výrazně početnější je okruh navrhovatelů než v minulosti. To dnešní Ústavní soud staví do výrazně vyššího postavení v rámci demokratického systému než v minulosti. Je také zahlcen individuálními stížnostmi. Obsah této bakalářské práce vede k zamyšlení, zda okruh navrhovatelů a omezenější pravomoci ústavního soudu v období první republiky, by nemohly být inspirativní i pro dnešní dobu. Jako vedlejší produkt se práce zabývá jmenováním soudců jak ústavního soudu, tak i soudů obecných.

Abstract:

The bacholor's thesis deals with a comparison of the powers of constitutional courts after 1918 and 1989. The Constitutional Court of the First Republic and the present. I concluded that today's court has significantly greater power and also significantly larger range of applicants than in the past. That puts today's Constitutional Court had in a leading role in the demokratic political system than in the past. It is also overloaded with individual complaints. The content of this thesis leads to consider whether the circle of proposers and limited powers of the Constitutional Court in the First Republic, could not be inspiring for today. As a byproduct of the work deals with the appointment of judges to the Constitutional Court and ordinary courts.
