Presidential Decrees and Restoration of Legal Order in CSR After World War Ilnd

Abstract:

Tato bakalářská práce se zabývá prezidentskými dekrety vydávanými v letech 1940-1945 a tzv. obnovou právního pořádku na území Československé republiky v období po druhé světové válce. V první části je stručně nastíněna historie česko-německých vztahů, jejichž vliv na poválečné uspořádání Československa byl nezanedbatelný. Další část práce je zaměřena na prezidenta Dr. Edvarda Beneše, který stál v čele exilového státního zřízení a na jehož teorii kontinuity první republiky byla dekretální normotvorba založena. Následující část charakterizuje období londýnského exilu, kdy byl mj. vydán i ústavní dekret o obnově právního pořádku. Je zde rozebrána příprava tohoto dekretu i jeho definitivní podoba. Z poválečných dekretů se práce zabývá dekrety majetkovými a dekrety upravujícími československé státní občanství, což úzce souvisí s osudem německé a maďarské národnostní menšiny na území ČSR. Celou bakalářskou práci uzavírá pojednání o současném stavu prezidentských dekretů. Je zde poukázáno na aktuálnost této problematiky a na četné diskuse, které neustále probíhají u nás i v zahraničí.

Abstract:

This bachelor thesis deals with the presidental decrees, that were issued in the years 1940-1945, and also with the restoration of the legal order in the territory of the Czechoslovak Republic in the period after the World War II. In the first part the history of the Czech-German relations is briefly outlined. Their influence on the post-war organization of Czechoslovakia was significant. The next part of the thesis is focused on president Dr. Edvard Beneš who was the head of the government-in-exile. His theory of continuity of the first republic was the lawmaking base for the decrees. The following part describes the period of London exile when among others the constitutional decree of restoration of the legal order was issued. The preparation of this decree as well as its definitive state are analyzed here. From the post-war decrees the thesis deals with the property decrees and the decrees modifying Czechoslovakian state citizenship that are closely related to the destiny of the German and Hungarian national minorities in the territory of the Czechoslovak Republic. The thesis is finished by the treatise on the present of the presidential decrees. The topicality of this issue and numerous discussions of it take place continuously both in our country and abroad. This fact is also mentioned in the thesis.
