Legal disputes in the construction industry or how to prevent problems in the construction of the work

Abstract:

Smlouva o dílo patří mezi jeden z nejčastěji používaných smluvních vztahů v soukromém právu. Dispozitivní ustanovení občanského zákoníku umožňuje smluvním stranám poměrně volné vymezení vzájemných práv a povinností, které oběma stranám vyhovuje. Diplomová práce posuzuje problematiku možných právních sporů při zhotovení díla především z pohledu zhotovitele. Základ kvalitní spolupráce spočívá v kvalitně sepsané smlouvě o dílo, která určuje práva a povinnosti jak zhotovitele, tak i objednatele. Práce je dělena na nejčastější a nejkritičtější problémy a spory, které mohou při výstavbě vznikat. Jednotlivé kapitoly obsahují právní aspekt, praxi stavebního oboru, a v neposlední řadě vlastní doporučení. Po přečtení této práce by obě smluvní strany měly být schopny identifikovat hlavní smluvní i zákonné úpravy, které jsou pro ně přínosné či naopak nebezpečné. Každá kapitola obsahuje upozornění na důležité povinnosti, které je třeba dodržet. Celá práce je koncipována jako příručka, jak ideálně sepsat smlouvu o dílo a tím předcházet možným problémům či dokonce právním sporům.

Abstract:

A work agreement belongs to one of the most commonly utilized private law agreements. Dispositive provision of the civic law allows agreement parties to provide a relatively flexible specification of the mutual rights and obligations which suits both parties. This diploma thesis assesses possible legal disputes that can arise during the agreed work primarily from the contractor's point of view. The basis of a fine collaboration lies in a well-written work agreement which specifies the rights and obligations of both the contractor and the customer. This thesis comprises the most common disputes and issues that can arise during the construction process. Individual chapters contain the legal aspect, the common practices in civil engineering and, last but not least, personal recommendations. After reading this thesis, both agreement parties should be able to identify the main agreement and legal adjustments that are either beneficial or unsafe. Each chapter contains notices about important obligations that need to be fulfilled. This work is organized as a textbook on composing an ideal work agreement helping to prevent possible complications or even legal disputes.
