Building Lands

Abstract:

Stavební pozemky a jejich právní režim jsou tématem poměrně rozsáhlým, neboť se jich dotýká celá řada právních předpisů. Zejména se jedná o č. 183/2006 Sb., o územním plánování a stavebním řádu (stavební zákon). Dále zákon č. 344/1992 Sb., o katastru nemovitostí České republiky (katastrální zákon), který ošetřuje evidenci stavebních pozemků v katastru nemovitostí, zákon č. 151/1997 Sb., o oceňování majetku, který upravuje způsoby ocenění stavebních pozemků, nebo zákon č. 338/1992 Sb., o dani z nemovitostí, kde je upravena konstrukce daně ze stavebních pozemků. Dále se stavebních pozemků týká celá řada zákonů, které ochraňují nejrůznější veřejné zájmy. Jedná se například o zákon č. 114/1992 Sb., o ochraně přírody a krajiny, zákona č. 20/1987 Sb., o státní památkové péči, zákona č. 334/1992 Sb., o ochraně zemědělského půdního fondu a mnohé další. Ve světle těchto zákonů je v bakalářské práci popsán režim stavebních pozemků, přičemž hlavní část je věnována procesu územního plánování. Na tomto procesu je určení stavebních pozemků závislé, ať už se jedná o vydávání dokumentů jako územní plán, který vymezuje plochy určené k zastavění nebo samotné územní rozhodnutí jako výsledek územního řízení. V práci jsou také zmíněny některé zjednodušující postupy v územním řízení.

Abstract:

Building lands and its system of law creates quite extensive topic because of its connection with many legal enactments. The most important legal enactment is Act No. 183/2006 Coll., Town and Country Planning Act and Building Act. Other important ones are: Act No. 344/1992 Coll., on Cadastre of Real Estates of the Czech Republic (Cadastral Law) which deals with the registration of building lands in real estate register; Act No. 151/1997 Coll., on evaluation of property that governs a manner in which the building land is evaluated; Act No. 338/1992 Coll., on real estate tax which defines the way of the calculation of tax base and building land tax rate. Another type of law serve to protect all sorts of public interests, e.g.: Act No. 114/1992 Coll., on the protection of nature and landscape; Act No. 20/1987 Coll., on state monuments preservation; Act No. 334/1992 Coll., on the protection of agricultural land and many others. In my bachelor’s project, the system of building lands is described in the light of these laws. The main part is devoted to the process of town and country planning. The delimitation of building lands is dependent on this process whether it is the editing documents as a territorial plan that delimitate areas intended to be built-up or the territorial decision as a result of area management. In the project, there are also mentioned some simplifying procedures in the process of.
