The Witness in the Criminal Proceedings
Abstract:
V mé bakalářské práci jsem se zabýval tématem a postavením svědka v trestním řízení. Důležitého pomocníka orgánů činných v trestním řízení, které zákonem stanoveným postupem zjišťují, zda byl spáchán trestný čin, nachází jeho pachatele, kterému poté podle zákona ukládají tresty nebo ochranná opatření a takové pravomocné rozhodnutí poté zřizují nebo vykonávají.

A witness, on the basis of summons by the active organs in the criminal case, undergoes the whole process of the criminal case because it is him/her who has experienced the crime with his/her senses. All this is recorded in the particular reports. The ability to perceive and to present this information is the only condition for the witness ´s status establishment. Keywords

Osoba svědka má proto pro trestní řízení velkou důležitost. A to nejen svým postavením mezi důkazními prostředky ale i tím že prochází celým trestním řízením už od stádia prověřování.
