The Line between Administrative and Criminal Offenses

Abstract:

Cílem této diplomové práce je vzájemné odlišení respektive vymezení hranic mezi přestupkem, který patří do správního práva trestního a trestným činem, který patří do trestního práva. Problematika je vysvětlena od základních obecných pravidel až po konkrétní rozlišovací kritéria doplněná praktickými příklady. Zaměření je pouze na vybrané nejčastěji se vyskytující druhy přestupků, s nimiž se setkávají především příslušníci Policie České republiky. Jedná se o přestupky na úseku ochrany před alkoholismem a jinými toxikomaniemi, proti veřejnému pořádku, proti občanskému soužití a proti majetku. Základem je popisná část, na kterou navazuje vymezení vyskytujících se problémů při aplikaci práva, spojená s úvahou o případném vývoji de lege ferenda.

Abstract:

The aim of this diploma thesis is mutual differentiation (respectively demarcation of the limits) between a misdemeanor, which belongs to the administrative criminal law and criminal act which belongs to criminal law. The issue is explained from the fundamental rules through to particular criteria of differentiation, supplemented by practical examples. It is focusing on selected most frequently occuring types of misdemeanors, by which are faced mainly Police of the Czech Republic members. These are the misdemeanors in the field of protection from alcoholism and other drug addictions, against public order, against civic cohabitation and against property. The basis consists from descriptive part, followed by the definition of the problems occuring in the application of law connected with the consideration of the evolution de lege ferenda.
