Obstructing Preparation and Course of Elections and Referendum from the Point of View of Juristic, Criminalistics and Criminology

Abstract:

Bakalářská práce zkoumá trestný čin maření přípravy a průběhu voleb a referenda z pohledu juristického, kriminologického a kriminalistického. V juristické části je zejména analyzována stávající právní úprava a vyslovena úvaha de lege ferenda. V části kriminologické je věnována pozornost pachateli zkoumaného trestného činu a možné prevenci. Kriminalistická část se věnuje odlišnostem dokazování tohoto trestného činu. V závěru práce je kriticky zhodnocena stávající právní úprava a navržena právní úprava de lege ferenda.

Abstract:

The thesis explores the obstructing of preparation and course of elections and referendum from the point of view of jurisdiction, criminology and criminalistics. In the juristic part is analysed the current legislation with the considerations for de lege ferenda. The criminology part focuses on the perpetrator and possible prevention. The criminalistics part deals with specific proofs of this crime. Finally, the current legislation is critically evaluated and the improvement of legal regulation de lege ferenda is offered.
