The Right to Complet an Incomplete Instrument
Abstract:
Blankosměnka je listina, která je určena za směnku a je podpisatelem záměrně vydána v nehotové podobě s tím, že nabyvateli je dohodou zřízeno tzv. směnečné vyplňovací právo k doplnění zatím chybějících náležitostí. Vyplňovací právo je zvláštní, jednostranné, neodvolatelné a nepromlčitelné právo majitele listiny doplnit do směnky předem určené náležitosti.
Abstract:
Blank bill of exchange is defined as a deed, determined as a bill of exchange and drawn up with some of the essentials missed on purpose, provided as early as the blank promissory note is made out that the completion of the missing parts is supposed to be executed afterwards by its acquirer who agrees with the Right of Bill of Exchange Completion.
