Abstract:

Bakalářská práce se zabývá institutem vykázání v rámci domácího násilí, zkoumá jeho funkčnost během i po jeho uplynutí a analyzuje definici, a právní úpravu domácího násilí. Institut vykázání, který je preventivní opatření chránící oběti domácího násilí, je upraven zákonem z roku 2006 a je prováděn policií ČR. Práce se dále věnuje definici domácího násilí, jeho formám a statistikám, a zkoumá právní vývoj této problematiky v České republice. Další kapitola se zaměřuje na samotný institut vykázání a roli policie při jeho provádění. Praktická část zahrnuje rozhovory s relevantními osobami a analýzu dat. Cílem práce je posoudit funkčnost institutu vykázání v praxi po jeho uplynutí a navrhnout případná opatření pro toto období.

Abstract:

The bachelor thesis deals with the institution of eviction in the context of domestic violence, examines its functionality during and after its expiry and analyses the definition and legal regulation of domestic violence. The institute of banishment, which is a preventive measure protecting victims of domestic violence, is regulated by the 2006 Act and is implemented by the police of the Czech Republic. The thesis further examines the definition of domestic violence, its forms and statistics, and explores the legal development of this issue in the Czech Republic. The next chapter focuses on the institution of eviction itself and the role of the police in its implementation. The practical part includes interviews with relevant persons and data analysis. The aim of the thesis is to assess the functionality of the institution of banishment in practice after its expiry and to propose possible measures for this period.
