Abstract:

Cílem diplomové práce je podat ucelený přehled právní úpravy institutu poznámky v katastru nemovitostí, s výjimkou poznámky spornosti. V diplomové práci se věnuji na základě analýzy předmětné právní úpravy, odborné literatury a relevantní judikatury jednak hmotněprávním otázkám jednotlivých druhů poznámek (poznámka k nemovitosti a poznámka k osobě), tak také procesním aspektům zkoumané problematiky (zápis a výmaz poznámky, zápis poznámky vs. vklad práva, možnosti obrany proti zápisu poznámky či stanovenými lhůtami apod.). Na základě takto provedené analýzy hodnotím, zda je podle mého názoru současná právní úprava dostatečná nebo by si zasloužila nějaké změny de lege ferenda.

Abstract:

The goal of this diploma thesis is to provide a comprehensive overview of the legal regulation of the institute of notes in the Land Registry, apart from notes of dispute. In my diploma thesis, based on the analysis of the legislation, professional literature, and relevant jurisprudence, I focuse on both the substantive legal issues of individual types of notes (note on real estate and note on a person), as well as procedural aspects of the investigated issue (writing and deleting notes, entry of a note vs. deposit of right, possibilities of defense against the entry of a note or deadlines, etc.). Based on the analysis carried out in this way, I assess whether, in my opinion, the current legislation is sufficient or would deserve some changes de lege ferenda.
