Public Law Contracts in the Practice of the Municipal Police

Abstract:

Tématem bakalářské práce jsou veřejnoprávní smlouvy v praxi obecních policií. Proto jsou úvodní kapitoly určené k seznámení se s těmito instituty správního práva. Následující kapitola se podrobněji zabývá veřejnoprávními smlouvami tak, jak jsou upraveny v zákoně o obecní policii. Další část popisuje účel a význam veřejnoprávních smluv, které uzavřely obecní policie na území Jihomoravského kraje, včetně kapitol, kde se autor snaží o zhodnocení potřebnosti takovýchto smluv. Pohledem de lege ferenda se snaží navrhnout řešení nastíněných problémů vznikajících nejednotným výkladem některých ustanovení zákona o obecní policii. Jako netradiční institut k zabezpečení místních záležitostí veřejného pořádku je popsán inspektor veřejného pořádku, se kterým je možno se setkat v některých městech.

Abstract:

This Bachelor thesis deals with public contracts in the practice of the municipal police. As the public contracts in the practice of the municipal police are the main topic of this thesis, the introductory chapters concentrate on institutes of administrative law. Secondly, the thesis deals in detail with the way, in which public contracts are modified in the law on municipal police. Furthermore, it describes the purpose and implications of public contracts, which have been entered into by the municipal police in the South Moravian Region. Moreover, the author of the thesis evaluates these contracts in terms of their usefulness and necessity. Also, he, from the point of view de lege ferenda, tries to suggest some solutions of the foreshadowed problems that are caused by the disunited interpretation of some provisions of the law on the municipal police. In addition, an inspector of public order, a non-traditional institute of the provision and support of local matters connected with public order, is dealt with in the thesis.
