Relationship between Right to Information and Public Interest thru "the Muzzle Act"

Abstract:

Tato práce se zabývá vztahem svobody projevu, práva na informace a veřejného zájmu v souvislosti s přijetím zákona č. 52/2009 Sb. označovaného jako „náhubkový zákon“. Tento zákon zvedl velkou vlnu kritiky tuzemských i zahraničních médií, která se domnívají, že náhubkový zákon postihuje svobodu médií a zavádí ve své podstatě cenzuru. Náhubkový zákon totiž zakazuje zveřejňování některých informací souvisejících s trestním řízením – hlavně informací o obětech trestných činů a odposleších. Podstatou práce je ozřejmit vztah mezi veřejným zájmem na informování veřejnosti médii a právy osob, o nichž média informují. V první části se práce zaměřuje na důkladné vymezení pojmů informace, právo na informace, ochrany osobnosti a veřejného zájmu. V následujících dvou kapitolách vymezuje konkrétní změny vyplývající z náhubkového zákona a jeho připravovaných novel. Čtvrtá kapitola přináší ucelený rozbor toho, jaká je nutnost ochrany účastníků trestního řízení, poměru institutu ochrany osobnosti a práva na informace a „ponížením“ práva na informace z důvodu nezbytnosti ochrany účastníků trestního řízení jako veřejného zájmu. Poslední část se zaobírá vztahem práva médií na zveřejňování odposlechů a veřejným zájmem.

Abstract:

This thesis deals with the relationship amongst the freedom of expression, the right to information and the public interest in connection with the adoption of Act. No. 52/2009 Coll. known as "the Muzzle Act". This law was criticised a lot by domestic and foreign medias that belive the Muzzle Act concerns the freedom of media and actually introduces censorship. The Muzzle Act prohibits publishing of certain information related to criminal proceedings – especially information on crime victims and wiretapping. The essence of the thesis aims to clarify the relationship between the public interest to inform the public by the medias and the rights of persons the medias inform about. The first part is focused on detailed definitions of information, the right to information, protection of personality and public interest. The next two chapters define the specific changes resulting from the Muzzle Act and its upcoming novelization. The fourth chapter provides a comprehensive analysis of what the necessity to protect the participants of criminal proceedings is, the stance of the institute of protection of personality and the right to information and the „humiliation“ of the right to information due to the need to protect participants of the criminal proceedings as a public interest. The last part deals with the relationship of the right of medias to publish wiretapping and the public interest.
