Court of Justice of the European Union and its role in the development of European integration

Abstract:

Stěžejním tématem této práce je význam Soudního dvora EU pro vývoj evropské integrace. Soudní dvůr má nepopíratelný podíl na současnou podobu Evropské unie. Jelikož nebyl závislý na politickém vývoji ve Společenství, stal se v 60. letech velmi důležitým pro prohlubování evropské integrace. Úloha Soudního dvora spočívá v zajišťování dodržování práva, jehož jednotné používání je významným nástrojem integrace a podporuje tak ideu postupného sjednocování. Cílem této bakalářské práce je zodpovědět si několik otázek, a to jaký přínos má Soudní dvůr Evropské unie pro rozvoj integrace, čím a jak dotváří právní řád EU a jak toto dotváření přispívá k integraci. Nejprve se budu zabývat vnitřním fungováním evropské soudní soustavy a jaké pravomoci má Soudní dvůr v institucionální struktuře EU. Poté se budu věnovat jeho soudcovské tvorbě práva a také dotvářením práva. Dotváření práva můžeme popsat jako vyplňování mezer v právních předpisech nebo odstraňování nedokonalostí. Soudcovská tvorba práva na rozdíl od dotváření nenavazuje na již existující právní normu. Takto byla vyvinuta například zásada přednosti evropského práva či pravidlo odpovědnosti státu za škodu způsobenou nesprávným přenosem evropského práva.

Abstract:

The case-law of the Court have had a crucial contribution to the legal system of the EU. It has developed fundamental constitutional principles of EU law which have not been mentioned in the original Treaties. In collaboration with ordinary citizens and the lower courts in the member states, it has managed to make Community law both directly effective and superior to the constitutional orders of the member states. The legal order which has been established through this long period is still developing. This thesis analyses the role of the European Court of Justice in the process of European integration. The role of the Court of Justice as an important supranational institution is discussed by taking into account various decisions of the Court that established the fundamental principles of the European Union Law. In this framework, the thesis will seek to answer such questions as: How did the Court play such an important role in the process of European integration? What are the contributions of the European Court in the development of the EU legal system?
