Foster and institutional care in the course of time

Abstract:

Rigorózní práce podává svědectví o vývoji pěstounské a ústavní péče v českých zemích, nastiňuje vznik tradice obou zdánlivě kontradiktorních způsobů realizace náhradní péče o děti bez rodinného zázemí a přibližuje jejich vývoj, účel, specifika, vzájemné odlišnosti i uplatnění v praxi. Text práce je členěn systematicky. Jednotlivé kapitoly prezentují časové úseky chronologicky řazené dle logických historicko-společenských předělů. Důraz je kladen na reflexi právního rámce, v jehož mezích byly obě jmenované formy náhradní péče realizovány. Nedílnou součástí rigorózní práce je také hodnocení dopadu obou forem náhradní péče v praxi. Teoretický výklad je z tohoto důvodu doplněn o vybrané příklady, které skutečné fungování ústavní i pěstounské péče výmluvně dokumentují. Pozornost je věnována také organizaci systému péče o děti bez rodinného zázemí a v neposlední řadě též proměnám postoje společnosti k této problematice. Rigorózní práce je vedena myšlenkou na význam komparace předchozího vývoje s dnešní situací, a to převážně s ohledem na nedávné změny v právní úpravě, které mohou zásadním způsobem ovlivnit dosavadní způsob realizace obou vybraných forem péče. Rigorózní práce předkládá komplexní pohled na problematiku pěstounské a ústavní péče u nás v období 20. století, včetně přesahu do minulosti a úvah de lege ferenda.

Abstract:

This thesis presents evidence of the development of foster and institutional care in the Czech lands, it outlines the origin of the traditions of both seemingly contradictory methods of providing substitute care for children without a family and describes the development, purpose, specifics, mutual differences and application in practice of both these types. The text of the work is divided systematically. Individual chapters cover sections of time arranged chronologically according to logical historical-social dividing lines. Emphasis is placed on reflexion of the legal framework, within the limits of which both named forms of substitute care were realised. Assessment of the impact of both forms of substitute care in practice is an integral part of this thesis, which is why the theoretical foundation is supplemented by selected examples, which truly document the functioning of institutional and foster care. Organisation of the system of care of children without families and the transformation of society’s standpoint towards this issue are also described. This thesis is based on the concept of the importance of comparing previous development with the situation today, particularly with regard to recent changes in legislation, which could fundamentally influence the method of realising both selected forms of care to date. This thesis presents a complex overview of the issue of foster and institutional care in this country during the 20th century, as well as overlapping into the past and consideration de lege ferenda.
