The Legal Aspects of Notification of Family Houses

Abstract:

Tato diplomová práce je zaměřena na proces ohlašování stavby rodinného domu do 150 m2 zastavěné plochy. Práce poskytuje ucelený přehled o ohlašování stavby rodinného domu především ve světle zákona č. 183/2006 Sb., o územním plánování a stavebním řádu. Jsou zde vymezeny základní pojmy, orgány, instituty a subjekty ohlašování. Uvádím zde také problémy, které v praxi vznikly platností nové právní úpravy účinné od 1. 1. 2007 a v souvislosti s tím i náměty de lege ferenda. V práci je naznačena i možná budoucí úprava dané problematiky, jelikož se připravuje tzv. velká novela stavebního zákona. Poslední kapitoly, uzavírající práci, popisují zjednodušeně provedení a užívání staveb, z důvodu komplexnosti celé práce.

Abstract:

This thesis is focused on the process of the notification of a construction of a family house which has a built-up area under 150 m2. The thesis provides a comprehensive overview of the notification of a construction of a family house especially in the light of Act No. 183/2006 Coll., Planning and Building Act. Basic terms, authorities, institutes and subjects of the notification of construction are defined. I also hereby present the problems that have arisen in practice as a result of the new legislation, which is effective from 2007, as well as suggestions de lege ferenda. The thesis includes the possible future adjustment of the issue, as the large amendment of the Building Act is preparing. The last chapters, that close the thesis, simply describe the implementation and the usage of the constructions because of the coherence of the whole work.
