Legal Aspects of Large Information Systems Distribution and Provision of Complementary Services

Abstract:

Tato diplomová práce komplexně analyzuje problematiku právních aspektů distribuce informačních systémů a souvisejících služeb. Práce má spíše deskriptivní charakter s prvky praktické aplikace. Vzhledem k prostoru jistě nedává vyčerpávající odpovědi na všechny řešené právní instituty. Je rozdělena do několika částí a postupuje od obecného ke konkrétním institutům. Úvodní kapitoly jsou věnovány objasnění hlavních pojmů a jejich zařazení, jež vyplývá z duševního vlastnictví a autorského práva. Jedna kapitola se věnuje licenčnímu oprávnění umožňující využití práv duševního vlastnictví dalším osobám. Obsahem závěrečných kapitol jsou právní prvky v předsmluvní fázi a ve fázi kontraktace, což je završeno rozborem vybraných smluvních typů, a to i s příklady konkrétních znění.

Abstract:

This diploma thesis analyzes the complex issue of the legal aspects of the distribution of information systems and related services. Thesis is due to rather descriptive character with practical application elements. Regarding to space certainly does not give exhaustive answers to all solved legal institutions. It is divided into several parts, proceeding from the general to the specific institutes. Introductory chapters are devoted to clarify key concepts and their classification, which derives from the intellectual property and copyright. One chapter is devoted to licensing approval to use intellectual property rights to other persons. The content of the final chapters are legal elements of the pre-contractual phase and in contracting, which is accomplished through analysis of selected types of contracts, even with examples of specific wording.
