The beneficial (real) owner of the AML regime

Abstract:

Bakalářská práce se bude zabývat institutem skutečného vlastnictví. Především pak novou právní úpravou přijatou na evropské úrovni v podobě V. AML směrnice. Tato směrnice byla nedávno implementována do českého právního řádu v podobě zákona o evidenci skutečných majitelů a novely tzv. AML zákona. Jádro práce však bude představovat nový zákon o evidenci skutečných majitelů. Primárním cílem práce je představit a analyzovat novou právní úpravu tohoto institutu. Rovněž jako zmínit některé problematické aspekty, které tento zákon přináší především v oblasti ochrany osobních údajů, které mohou být novou právní úpravou dotčeny.

Abstract:

The bachelor thesis will concern with the institute of the beneficial ownership. In particular, the new legislation has been adopted at European level in the form of the V. AML Directive. This directive was recently implemented into the Czech legal system in the form of the Act on the Registration of Beneficial Owners and an amendment to the AML Act. However, the core of the thesis will be based on a new law on the registration of beneficial owners. The primary goal of this thesis is to present a new legal regulation of this institute. As well as mentioning some problematic aspects that this law brings, especially in the area of personal data protection, which may be interfered.
