Disciplinary proceedings in penitentiary practice and investigation of crimes in the prison

Abstract:

Diplomová práce se zabývá kázeňským řízením v penitenciární praxi a vyšetřováním trestných činů ve věznici. Kázeňské řízení je velmi specifická oblast, na kterou Vězeňská služba České republiku musí být neustále připravena flexibilně reagovat tak, aby bylo možné udržet pořádek a bezpečnost ve věznicích na požadované úrovni. Práce se bude zabývat legislativní úpravou a požadavky kladenými na kázeňské řízení. Část práce bude věnována činnosti Pověřeného orgánu Vězeňské služby České republiky, jehož spolupráce s orgány činnými v trestním řízení je velmi důležitá pro potřeby kázeňského řízení. Důraz v diplomové práci je kladen především na praktické poznatky přímo z věznice VV Praha – Pankrác, které umožní ucelenější pohled na celou problematiku. Práce by měla přispět k bližšímu poznání a stanovit případné doporučení pro doplnění daných témat, poukázat na vliv legislativních změn při ukládání kázeňských trestů a úskalí při vyšetřování trestných činů ve věznici, která jsou přímo spjata s kázeňským řízem.

Abstract:

The diploma thesis deals with disciplinary proceedings in penitentiary practice and the investigation of criminal offenses in prison. Disciplinary proceedings are a very specific area to which the Prison Service of the Czech Republic must be constantly prepared to respond flexibly in order to maintain order and security in prisons at the required level. The work will deal with legislation and requirements for disciplinary proceedings. Part of the work will be devoted to the activities of the Authorized Body of the Prison Service of the Czech Republic, whose cooperation with bodies active in criminal proceedings is very important for the needs of disciplinary proceedings. Emphasis in the diploma thesis is placed mainly on practical knowledge directly from the prison VV Praha – Pankrác, which will allow a more comprehensive view of the issue. The work should contribute to a closer knowledge and set possible recommendations for supplementing the topics, point out the impact of legislative changes in the imposition of disciplinary punishments and pitfalls in the investigation of crimes in prison, which are directly related to disciplinary proceedings.
