The Specifics of EU Law Intepretation

Anotace:

Diplomová práce se zabývá interpretací evropského práva a snaží se odpovědět na hypotézu, zda se interpretace práva EU vyznačuje specifiky, která ji odlišují od výkladu práva vnitrostátního i práva mezinárodního. Za tímto účelem je interpretace práva EU analyzována a porovnávána s právem vnitrostátním a mezinárodním v oblasti pozitivněprávního zakotvení výkladu, metod výkladu a subjektů výkladu.

Abstract:

The thesis deals with the interpretation of the EU law and tries to answer the hypothesis whether the EU Law has some specifics within its interpretation which make it different from the interpretation of national and international law. In order to solve the question the Interpretation of the EU Law is analysed and compared with the national and international law within spheres including anchorage of general rule for interpretation within legal acts, methods of interpretation and subjects of interpretation.
