Termination of the Contract and its Effect on Property Rights

Abstract:

Diplomová práce se zabývá účinky odstoupení od smlouvy podle aktuální právní úpravy. Jejím cílem je objasnit, zda má odstoupení od smlouvy samo o sobě vliv nejen na závazková, ale také na věcná práva, a to skrze analýzu současné regulace účinků odstoupení od smlouvy a jejího srovnání se starší právní úpravou a zahraničními přístupy k této problematice. Ze samotného znění zákona totiž odpověď na kladenou otázku jednoznačně nevyplývá. V práci jsou rovněž popsány důsledky, které (ne)existence věcněprávních účinků odstoupení má, a to i mimo oblast občanského a obchodního práva.

Abstract:

The thesis is focused on the effects of termination of the contract under the present legislation. Its objective is to make it clear whether the termination has an effect not only on obligations, but also on property rights by analysing the current regulation of the effects of termination, from which no clear answer to the issue at question emerges, and by comparing it with older legislation and foreign approaches to this issue. The thesis also describes the consequences of the (non)existence of proprietary effects of termination, including those outside the area of civil and commercial law.
